The Tier 1 Entrepreneur visa scheme is now closed to new applicants and two new entrepreneur visa schemes – the Start-Up visa and the Innovator visa – have recently been introduced.
It is too early to assess the Start-Up and Innovator visas. Both these visas require endorsement from private bodies, not from the Home Office, and we do not yet know how easy or difficult this is going to be.
But there is another kind of visa – Representative of an Overseas Business visa – which has at least some similarities to entrepreneur visas. The important difference between this visa and other kinds of entrepreneur visa is that it is based on an overseas company. If an overseas company wants to set up a business entity in the UK it may wish to appoint a senior employee to come to the UK and set up and run the new entity on behalf of the overseas company.
The overseas company can for this purpose create either a UK branch or a wholly-owned UK subsidiary, and it can be trading in any area in the provision of goods or services. And the company must prepare a good business plan to explain how the proposed UK entity intends to succeed and prosper.
The appointed representative can apply for a Representative of an Overseas Business visa and if the application is successful the visa will typically be granted for three years. Dependants (partner and children aged under 18) may also be able to apply.
After three years, and if the UK entity is trading well, it may be possible to apply for an extension visa and after five years in total it may be possible to apply for settlement.
The representative can be a shareholder of the overseas parent company but must not be a majority shareholder.
This visa has been around for some years and it is tried and tested, and we at Get UK Visa have some years’ experience of it. It is not part of the points-based system, and does not have all the complexity of a Tier 1 Entrepreneur visa application.
It could be a very good option for overseas companies which wish to expand their operation into the UK and it could also be a very good opportunity for senior employees of such companies to demonstrate their entrepreneurial skills.
