Settlement/Settled Status/Indefinite Leave to Remain

“Settlement”, “Permanent Residence” (PR), “Settled Status” and “Indefinite Leave to Remain” (ILR) all mean the same thing: the right to live and work in the UK without restriction on a permanent basis and the right to leave the UK and re-enter – as long as you do not stay outside for too long.

“Permanent Residence” was the old term that was used in EU law which has now been replaced by “Settled Status”.

If you acquire settlement you will retain your original nationality. Settlement does not provide all the benefits that British citizenship does but it does provide a lot of them.

In most cases settlement is acquired by living in the UK for a certain number of years. A migrant who has leave on a working visa, family visa or EEA visa may be able – depending on their circumstances – to apply for settlement after five years’ continuous leave.

And, under a different rule, a migrant may be able to apply for settlement after ten years’ continuous lawful leave on any combination of visas.

Migrants in some Tier 1 and Innovator categories may be eligible for settlement in three years or even two years and, in a few other cases, a migrant may be entitled to settlement straightaway.

And in cases where the migrant is relying on unlawful residence in the UK it may possible to acquire settlement, but the rules about his are quite complicated. In every case the migrant must have lived in the UK for at least five years and in some cases the required period is much longer than this.

  • review rating 5  I highly recommend GET the UK Visa, I've selected them for my ILR application as a British Spouse. In the beginning, I was a little bit sceptical and scared. I was coming from an agency where the solicitor did not know anything about the new digital rules, and I was freaking out every time I was talking to this lady. (At that time the digital application was new for me because I made my previous applications in an analogue way and with no solicitor help). Adel and all the team were extremely patient; they listened to us and gave us all the confidence and knowledge to understand all the new digital process. He's been all the time next to us, answering all the questions and doubts. Even if I was having over and over again the same needs and doubts, he was always there. I had our Residency approved on the same day Application. We decided, with no doubt, that he was also going to help us with my citizenship, which I've applied on the 22nd of February 2020. Due to Covid-19, he received my approval letter at the beginning of August 2020. The real date of the approval was the 24th of March 2020.
