A partner can be a spouse, a civil partner (same-sex relationship), an unmarried partner, a fiancé(e) or a prospective civil partner (same-sex relationship). The relevant definition of an unmarried partnership is that the parties have already lived together in a relationship like marriage for at least two years (in either the UK or outside the UK).
UK immigration law may enable a non-EEA partner to join or remain with their partner in the UK, if the partner in the UK is a British citizen or holds settlement or refugee/humanitarian protection status.
Fiancé(e)/Prospective Civil Partner visas have rather different rules from the other categories. The visa can only be applied for from outside the UK and is granted for only six months. The visa holder is not allowed to work, and they are expected to marry/form a civil partnership within the six-month period, and then they can apply in-country to switch to a Spouse or Civil Partner visa.
The other visas can all be applied for from either outside or within the UK (depending on the applicant’s circumstances) and the initial grant of leave is for 30 months. At the end of the 30-month period, if the relationship is still subsisting and if all the other requirements are still met, it will be possible to extend the visa. After either five years or ten years (depending on the circumstances) it may be possible to apply for settlement.
The basic types of requirement for partner visas are as follows but, very importantly, requirements vary depending on the applicant’s situation:
-Showing that the relationship is genuine.
-Showing that financial earnings or savings are sufficient
-Showing that accommodation is adequate
-Showing that the English language level is high enough
Partner visa applications tend to be complex, and this can particularly be the case when assessing the financial earnings/savings. The calculations can be complex and the evidential requirements are very precise.
