Representative of an Overseas Business

The immigration rules for this visa route have been changed recently, although the changes were not really major.

The Representative of an Overseas Business visa (often referred to as a “Sole Rep” visa) enables a senior employee of an overseas company to come to the UK, set up a branch or wholly-owned subsidiary of the overseas company, and run it. If things go well it provides a route to settlement for the main applicant and any dependants. And also of course it provides the overseas company with a useful business presence in the UK.

The recent changes to the rules generally reinforce the requirements of genuineness in the application: for example they strengthen the criteria for establishing that the applicant does not have a controlling interest in the overseas company.

But these changes do not create any new principles – they merely serve to tighten up the existing ones.

With forthcoming Brexit, this visa route may acquire enhanced importance. We imagine that companies from the EEA may be able to take advantage of it. EEA nationals will lose the immigration rights that they have at the moment, and they will need to look at other possibilities.

I was coming from an agency where the solicitor did not know anything about the new digital rules, and I was freaking out every time I was talking to this lady. (At that time the digital application was new for me because I made my previous applications in an analogue way and with no solicitor help). Adel and all the team were extremely patient; they listened to us and gave us all the confidence and knowledge to understand all the new digital process. He's been all the time next to us, answering all the questions and doubts. Even if I was having over and over again the same needs and doubts, he was always there. I had our Residency approved on the same day Application. We decided, with no doubt, that he was also going to help us with my citizenship, which I've applied on the 22nd of February 2020. Due to Covid-19, he received my approval letter at the beginning of August 2020. The real date of the approval was the 24th of March 2020. So it means that thanks to Adel, the Home Office approved my citizenship a month after my application!!!!! Thank you very much to Adel and all the team!!
